  4. Statement of Good Faith: A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.

  5. Statement of Accuracy: A declaration, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.

  6. Electronic or Physical Signature: An electronic or physical signature of the person authorized to act on behalf of the copyright owner.

Please Note: Any person who knowingly misrepresents that material is infringing may be subject to liability under the DMCA.


Counter-Notification Procedure

If you believe that your material was removed or disabled by mistake or misidentification, you may file a counter-notification with us. Please send your counter-notice to [email protected] including the following information:

  1. Identification of the Material: A description of the material that has been removed or disabled and its location before removal (e.g., specific URLs).

  2. Your Contact Information: Your full name, mailing address, telephone number, and email address.

  3. Statement Under Penalty of Perjury: A statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.

  4. Consent to Jurisdiction:

    • If you are in the United States: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located.
    • If you are outside the United States: A statement that you consent to the jurisdiction of any Federal District Court where aghconsultor may be found.
  5. Acceptance of Service of Process: Your consent to accept service of process from the person who provided the original infringement notification or an agent of such person.

  6. Electronic or Physical Signature: Your physical or electronic signature.

Important: If you are unsure whether the material infringes on intellectual property rights, we recommend consulting an attorney before filing a counter-notice. Misrepresentation in your counter-notice may result in legal consequences.


Restoration of Removed Content

Upon receiving a valid counter-notification, we will:

  • Forward the Counter-Notice: Send a copy of the counter-notice to the original complaining party.
  • Wait Period: Wait 10 to 14 business days to allow the original complainant to seek a court order against the content provider.
  • Content Restoration: If no legal action is initiated, we may restore the removed material or cease disabling access to it.

Repeat Infringer Policy

We take intellectual property rights seriously and have a policy to terminate, in appropriate circumstances, users who are repeat infringers. We maintain a record of notices of alleged infringement and take action when necessary to uphold our policies and legal obligations.

  • Account Termination: Users with multiple infringement notices may have their accounts terminated without prior notice.
  • No Tolerance: We reserve the right to terminate accounts that violate our Terms of Service, regardless of the number of infractions.
